This false claiming of DMCAs are starting to really get to me. Not just because of trolls targeting pony episodes. But they have also caused so many people I know online in the last 5 years to suffer because of it. When I used to be an activist of..... something I won't go into. Many of my friends in that community constantly and frequently had their channels taken down due to false DMCA claims and these were people that were not breaking copyright laws at all. These false DMCA claims were used as a form of censorship, to silence people who were saying things they did not like and many people I knew who got hit could not be bothered with the huge amount of effort involved in disputing claims. When a DMCA claim is made youtube is required by law to take down the video first then ask questions later. Why are the Millennium copy right laws so exploitable? Why haven't they reformed them. False DMCA claims should have serious consequences to deter people from doing it. People making a claim should be required to give their personal details, to help prove they are who they say they are and if they are lying there should be hefty fines or jail time. Discuss Everypony.
I agree. Taking down pony episodes because a "Representative" of Hasbro says to is really really stupid. YouTube need to start thinking about what the heck they do.
Between Youtube and laws themselves, something needs to get fixed. I completely agree here and it's basically why I don't make videos much anymore. Granted, people use this to amuse themselves too but a lot would be fixed if the laws regarding copyrighted material were revised to fit modern standards.
I agree, I've never liked certain extents of copyright law and the sort. I'll also admit to having many strong opinions on political and legal issues like that though... I may have become a bit biased due to that. But I've always agreed to this. And they definitely should revise the laws regarding copyrights and that sort, too.
We'd all be better off if they got rid of the claim thingy. I mean come on, they're smart enough to know if the DMCA are in question, aren't they?!?
Discuss? Not much to discuss really, everything you said was absolutely true. The system in which YouTube operate copyrights is flawed beyond sense, and they don't seem to be in any rush to address this. The fact that someone can issue a copyright anonymously, even worse, under a false identity, will be considered legitimate without any form of verification is laughable. Really, the way someone could just pretend they were Hasbro, flag a few videos, and then have YouTube actually go ahead with it is almost a very unfunny joke. The sad thing is, I can't see them listening to the voice of reason and actually going ahead and performing simple validations to ensure the claim is authentic and justified. Oh look, a letter. So, you think we should ask for basic proof of identity? SEEMS LEGIT And so we find ourselves in the position we are in now.
You need to look at the other side too. You'd have people exploiting it on their end and Youtube could end up with a lawsuit. The system is very broken but instead of ditching it, they need a drastic revision of it.
Unfortunately the laws surrounding dmca claims aren't there to provide a fair basis for free each and protection of personal content, no they're geared for the huge company so they can take down anything that could even remotely cause them to lose a penny without devoting any time or effort into determining the situation. Unfortunately, these companies are where /you/tube gets all their profit so I doubt they'll bother listening to the small producers that constitute the majority of their userbase
DRD don't double post.... Its really annoying how long can it take to insure that the claim is valid I'll guess I'll have to fine comb the DMCA and check it to see. Though this entier thing will be blown if the that stupid even tougher bill gets pasted so they dont even need to get s claim to bring it down it just has to be seen by goverment and *boom* head shoot. MLP:FIM would be no where without youtube and other hyping it up and spreading it and Hasbro know this and are laid back with it, surly YouTube know that... Im not arguing against the law because copyright protection and stuff needs to exists but the laws should work in such a way that YouTube cant be sued unless they start directly denning to take down content when they have fully confirmed the claim is legit. Bill s978 is the one I'm on about you know the one that will kill most game companies profits and if it existed before would make minecraft tiny and may have stopped red vs blue, and certainly would mean I wont be here right now on a Brony board.
As if I double posted. Look at the poster above my "so-called" double post. That's Derpy Hooves. :derpe:
Ah, an honest mistake. But yeah, I do hope YouTube sorts out their system, but I just can't see it happening. Shame.
